Terms of use

By creating an account or using Vizioa, you accept these terms. If you act on behalf of a company, you confirm that you are authorised to bind it.

User

Any person who accesses the website or the application.

Customer

The company holding a paid subscription.

Project

A set of measurement settings: brand, website, competitors and tracked prompts.

Prompt

A question submitted to the engines as part of a project.

Run

One execution of prompt × engine × date.

Mention

The brand name appears in the text of the answer.

Citation

A URL from the brand's domain appears in the answer's sources.

Vizioa measures a brand's visibility in AI assistants' answers. It submits the tracked prompts to the engines included in the plan, at the planned frequency, and presents the results in a dashboard, with email alerts.

Vizioa only measures. In particular:

• it does not change the user's website and requires no installation on it;
• it does not write or publish any content;
• it does not guarantee any visibility, mention or citation result;
• it does not establish any cause-and-effect link between an action by the user and changes in results.

Answers are obtained through APIs. They can differ from those obtained by a logged-in user, whose answer depends in particular on memory, history, personalisation and location. Answers also vary from one execution to the next. Results are therefore directional: they are meant to be compared over time, not read as absolute values.

Users provide accurate information and keep it up to date. They keep their credentials confidential and remain responsible for the use of their account. Any unauthorised use must be reported without delay to contact@modernova.studio.

Users agree to:

• use Vizioa in accordance with the law and these terms;
• not include personal, confidential or unlawful data in prompts;
• comply with the usage policies of the engine providers to which prompts are sent;
• not circumvent the limits of their plan, disrupt the service, attempt unauthorised access or extract data by automated means;
• not decompile, copy or resell the software without written agreement.

Users keep their rights over what they enter (brand, competitors, prompts). They grant Modernova Studio LLC the right to process it only as needed to provide the service.

The answers displayed are produced by third-party engines. Vizioa shows them without guaranteeing their accuracy. The brands and content they contain belong to their owners.

Customers may use the results for their internal needs and, on the Agence plan, share them with their own clients.

The Vizioa software, its code, interface, calculation methods and documentation remain the exclusive property of Modernova Studio LLC. The subscription grants a personal, non-exclusive and non-transferable right of use for the duration of the subscription.

Vizioa strives to provide continuous access to the service, without guaranteeing permanent availability. Interruptions may occur for maintenance or in case of incidents.

The service depends on the engine providers' APIs. Changes to them, their unavailability or the end of access may affect measurements.

In case of serious breach of these terms, Modernova Studio LLC may suspend or close the account concerned, after notice by email except in an emergency. Users can close their account at any time, under the conditions set out in the terms of sale.

Vizioa is bound by a best-efforts obligation. It is not responsible for the content of answers produced by the engines, nor for decisions made by users based on the results. Liability limits applicable to customers are set out in the terms of sale.

The processing of personal data is described in the privacy policy.

These terms may be changed. Users are informed of any significant change by email [notice period] before it takes effect. Continued use constitutes acceptance.

These terms are governed by [governing law to be approved]. Any dispute falls under [competent jurisdiction to be approved], after an attempt at amicable resolution.
